Terms of Service

These Terms of Service ("Terms") form a legal agreement between you and Growth Setup Limited ("Growth Setup", "we", "us", or "our"), registered in England & Wales under number 17028589.

By creating an account, purchasing a plan, or using any part of the platform, you confirm that you have read and accepted these Terms and related policies linked in the site footer.

For these Terms:

• Platform: The Growth Setup website, application interfaces, dashboards, and related software services.
• Audit: The Growth Readiness Audit workflow and generated score/report outputs.
• Customer Data: Data submitted by you or your users into the platform.
• Subscription Term: The paid period for your selected plan, monthly or annual.

You must be at least 18 years old and legally able to enter contracts. If you use the platform on behalf of an entity, you represent that you are authorized to bind that entity.

You are responsible for safeguarding credentials, controlling user access in your organization, and notifying us promptly of suspected unauthorized account activity.

Growth Setup provides business analytics software for growth planning, including AI-assisted assessments, readiness scoring, reporting, and roadmap generation.

We do not provide financial, banking, money transmission, investment, tax, legal, or regulated advisory services. Platform outputs are intended to support internal planning decisions.

Paid plans are billed in advance and renew automatically unless cancelled before the next renewal date. You authorize us and our payment processor to charge the selected payment method for recurring fees and applicable taxes.

Pricing, feature limits, and included usage are displayed on the pricing page. We may update pricing for future billing cycles with reasonable advance notice.

You are responsible for taxes, duties, and governmental charges associated with your subscription, except taxes based on our net income.

We may offer free or discounted access. Trial features may be limited and may expire automatically at the stated end date. Unless explicitly stated, trial access does not create a right to continued free service.

We may modify or withdraw promotional offers at our discretion where misuse, fraud, or abuse is identified.

You may cancel at any time from your account settings. Cancellation takes effect at the end of your current paid term, and no additional recurring charge will be taken after the cancellation date.

Downgrades can reduce available features, seat limits, or historical data access according to the selected plan. Refunds are handled under the Refund Policy.

You retain ownership of Customer Data. You grant us a limited, revocable license to host, process, and transmit Customer Data solely to provide, secure, and improve the platform.

We process personal data according to our Privacy Policy. You are responsible for ensuring you have lawful rights to submit Customer Data to the platform.

Growth Setup and its licensors own all rights in the software, interfaces, trademarks, reports templates, and related technology, excluding your Customer Data.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the platform for internal business purposes during an active subscription.

You agree to use the platform lawfully and according to our Acceptable Use Policy.

Prohibited activity includes security abuse, malicious automation, credential sharing, unlawful processing of personal data, and attempts to misrepresent audit outcomes for fraud or deceptive conduct.

Service delivery depends on third-party providers such as hosting, identity, payment, and AI infrastructure vendors. We are not responsible for outages caused by external providers, but we work to restore service promptly.

Third-party services are governed by their own terms and privacy notices.

Platform results are generated by AI models and software logic using the data provided. Outputs may contain assumptions, gaps, or interpretation limitations and should be reviewed before operational execution.

You remain solely responsible for all strategic, financial, legal, hiring, and operational decisions made using platform outputs.

We aim to maintain reliable service operation and secure engineering practices, but uninterrupted or error-free availability is not guaranteed. Maintenance, upgrades, and emergency controls may temporarily affect access.

Support response times vary by plan and request complexity.

To the fullest extent permitted by law, the platform is provided "as is" and "as available" without implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Our total aggregate liability for all claims related to the service will not exceed the fees paid by you to Growth Setup in the 12 months before the claim arose.

You agree to indemnify and hold harmless Growth Setup Limited from losses, liabilities, and costs arising from your unlawful use of the platform, policy breaches, or infringement of third-party rights.

We may suspend or terminate access where necessary to protect platform integrity, investigate suspected abuse, comply with legal obligations, or prevent harm to users or systems.

On termination, your right to use the platform ceases immediately. Data retention and deletion are handled under our Privacy Policy and applicable law.

These Terms are governed by the laws of England and Wales. Subject to mandatory consumer rights, disputes will be resolved in the courts of England and Wales.
